Regulations Pending:
H.R. 3790-Repeal of Competitive Bidding
House Bill 3790 is a bill currently in the House of
Representatives that would repeal Competitive Bidding
for medical equipment and supplies. In 2006 competitive
bidding was enacted in several metropolitan areas across
the country and was subsequently repealed due the
government’s inability to appropriately implement the
laws requirements. Competitive Bidding was reinstated in
2010 again in several metropolitan areas throughout the
country. Competitive Bidding for home medical equipment
is wrong for supply and delivery of home medical
equipment. This bill will reduce competition therefore
eventually increasing prices to the government, reduce
access for beneficiaries as winning bid companies will
not be able to serve the wide geographies they initially
thought they could, and patient choice of providers will
all but be eliminated.
H.R. 3790 currently has over 200 co-sponsors in the
House of Representatives to repeal competitive bidding.
Most of our New England delegation has signed on, but we
must continue to let them know that competitive bidding
for home medical equipment is wrong for beneficiaries
and the small businesses that make up the majority of
HME providers.
